摘要: | 全球化的趨勢,使現今企業面臨了更多的不確定性與競爭性,近代勞工意識抬頭,使企業在勞動彈性化需求增加,使「勞動派遣」的僱用模式出現。1967年德國聯邦憲法法院判決中合法化勞動派遣後,派遣僱用便迅速蔓延。對此,為防止派遣機構大量出現形成惡性競爭、剝削派遣勞工權利、降低勞動條件或造成勞動市場混亂,於1972年制定勞動派遣法。臺灣現今正面臨勞動派遣僱聘模式快速發展的現況,但國內卻並無專法規範,使勞動市場之爭議事件層岀不窮。本研究將針對德國發展勞動派遣,其專法中勞資三方權利義務規範、發展過程、發展現況等,對現今臺灣制定勞動派遣相關法作為借鏡,本論文研究摘要說明如下: 第一章為緒論,包括本文研究動機、研究目、文獻回顧與研究架構加以說明,藉以瞭解本論文題目產生背景,並稍加說明各章節之內容。第二章回顧德國勞動派遣發展緣由、派遣定義,以及相關政策等。此外,於發展時權利義務規範的推行與發展困境進行說明。第三章將對派遣發展對勞資方優劣進行探討,並對德國勞動派遣法中,勞資三方規範之權利、義務進行說明。此外,為移民大國的德國,移入的合法移民僱用其派遣,聯邦政府於此之相關政策進行說明。第四章將對歐盟非典型指令架構進行探討,瞭解指令架構下對勞動派遣的影響。並探討德國發展勞動派遣至今,行政機關、工會組織之態度與對策方向。接著則對臺灣現今勞動派遣發展現況、困境進行探討,說明專法制定之必要性。第五章為結論,本章將整合前面各章所得之結論,進行分析與整理,總結本文所述,提出結論與建議。 Owing to the globalization of laborer market, the companies nowadays face many competitions and uncertainties. And because of the rise of laborer-right consciousness, many companies choose to take advantage of laborer dispatch as a way to save expenses. Ever since the Federal Constitution Court of Germany legalized laborer dispatch, labor dispatch has been growing rapidly. In order to prevent the exploiting of laborers’ right and ensure the order of laborer market, a law for laborer dispatch was enacted in 1972. In Taiwan, laborer dispatch has been growing rapidly but there is not as yet a law to regulate the labor dispatch. Because of this, there are more and more disputes in laborer market. The purpose of this research is to discuss the laborer dispatch law of Germany for regulating the rights and obligations for both the employer and the employee, and its present development to serve as a reference for enacting a law for laborer dispatch in Taiwan. The first chapter is an introduction, which includes an explication of my motivation, and purpose of this research, a literature review, and the structure of my dissertation. From this introduction, readers may see the background of my research. In this chapter, I also briefly summarize the content of each chapter. In Chapter Two, I trace the cause, definition, and related policies of laborer dispatch in Germany. I also explicate the difficulties in developing and carrying out the regulations for the rights and obligations of laborer dispatch. In Chapter Three, I first discus the advantages and disadvantages of laborer dispatch for both the employer and the employee. I also explicate the rights and obligations for both the employer and the employee. I turn to discuss the related labor- dispatch policies for Germany, which has so many legal immigrants. In Chapter Four, I discuss the atypical structure for the Consul of Europe to see the structure’s influences of laborer dispatch. I also discuss the attitudes and policies from the government institutions and laborer union toward this laborer dispatch in Germany. Finally, I discuss Taiwan’s present labor dispatch condition and difficulties, and argue the necessities for enacting a law for labor dispatch. In the conclusion, I analyze and combine the conclusions of my previous chapters and give suggestions. |
