本研究以敘事探究方法,邀請曾被多次判處死刑並最終獲判無罪者參與研究,意欲了解並敘寫歷經多次死刑判決者在經法官確認冤獄並獲判無罪後所遭逢的經驗與想法,以探討無罪判決確定後研究參與者遭遇的難題及其處理歷程,進而省思司法體系與研究參與者的關係建構,並於實際訪談歷程中建構敘事探究的研究方法。 從死刑制度變遷的觀點,回顧台灣司法改革的歷史脈絡與死刑犯研究的相關文獻後,本研究之敘事分析分別從「良民與殺人犯」、「天真?不妥協!」、「堅持與放棄」、「信任與質疑」、「賠償與等待」等向度,探討研究參與者在獲判無罪後所需面對的實際生活問題與衝突,藉以凸顯參與者身處之社會性脈絡及其人生觀轉變情形。 本研究發現,冤獄事件發生後,研究參與者因數年的羈押、審判,加上死刑的陰影時刻壟罩心頭,早已習慣用這段經歷來解釋他全部的世界,對身旁的人、事、物皆習慣性的以「不信任」來因應。當某社會事件的背景資訊不夠透明時,研究參與者會有一套類似陰謀論(Conspiracy)的說法,除了對這些事件顯示出猜疑與恐懼,並且深信控制社會的幕後黑手確實存在。 熬過三千八百多個死刑如影隨形的日子後,研究參與者一樣必須承受社會異樣的眼光和難以找到工作的窘境,對此情況,其因應方式較為積極,可以感覺他已接受情境的現實,並以正向的態度重新看待問題。除此之外,被冤判死刑的經驗依舊造成難以抹滅的傷害,心中的不甘心似乎已注定是他餘生最大的束縛。 This study aims to investigate the experiences of the man who sentencing resulting from frame-up in Taiwan. He had been sentenced to die eight times and has spent nine years on death row for a crime he did not commit. Data was collected through narrative interview – the stories told by the research participant (A-Cheng). The researcher trying to apply the 'holistic - content' and 'categorical - content' approaches of narrative research to reveal the life story of the client and classifying the realization in her depression and the changes of life after released. This study begins with a review of the Death Penalty system in Taiwan, and an in-depth exploration of the narrative inquiry method. The process and ethics of narrative inquiry was explored order to ensure the study’s reliability. The narratives were then analyzed along five dimensions: a law-abiding guy/ a homicide, innocent/ unbending, to keep up/ to surrender, trust/ to query, indemnification/ to wait for. The main objective of the analysis was to explore the conflicting dilemmas and extreme stress of the innocence people.Because of few research has ever shed light on such an issue especially in Taiwan. This thesis hopes to provide a fresh perspective for innocence people. Further more, this thesis hopes to inspire different social groups to discuss the issue.
