    Abstract:   歐盟的整合在歷經五十年的演進與發展下,其歐盟自身和會員國之間的關係業已逐漸發展進而成為一特殊的政治體系。儘管在對於評析歐盟現狀的認知和觀點有所爭議異聲,但隨著會員國主權不斷地向上轉移至歐盟、向下轉移至地方政府,或平行轉移至非政府性質的利益團體時,歐盟不啻成唯一所謂的「多層次治理」的模式體系,即包含著超國家、國家、次國家,以及跨國家層次行為者,並於整合及政策制定的範疇上皆各自扮演著關鍵的角色之一。此外於本文中,肇因於主權讓渡的不完整性,如穩定暨成長公約而言,其政策評析的氛圍漸厥為焦點之ㄧ。    是故,本文嘗試著在歐盟多層次治理體系下,透過所謂具「軟法」性質的治理來加以剖析穩定暨成長公約之改革現象與影響。然於分析當中,幾個面向將隨著公約的先後發展而被提出,包括:(1)政策權力的分散與不集於單一層次;(2)會員國政經體質的需求差異;(3) 超國家機構政策規範的強度和範圍。    最後,本文於結論裡,透過提出具軟法性質治理一途徑對公約的評析後,可以暫時得出囿於公約中本身硬法的不足解釋與解決,以及當中超國家層次與國家層次互動的情形和回應,因此公約適合含著一混合式的治理模式-即硬法與軟法的治理型態。同時,並指出所謂軟法治理的模式或觀點程度上不外乎仍是一強權政治的象徵、延伸。
      After the five-decade evolution and development of European Integration, the alliance of the member states and the European Union are gradually developing into a sui generis political system. Although there still some controversies over the definitions and perspectives of EU situation, with the sovereignty of the member states distributed upwards, downwards and sidewards to the EU, the local government and the public or private interest groups, the EU has become the so-called “MLG, multi-level governance,” supranational, national, subnational, as well as transnational actors and institutions all play a key role in European integration and policy-making system. Beside, due to the sovereignty ceded incompletely like the “Stability Growth Pact- SGP” in this thesis, the issue of policy case study mentioned above have been drawn increasing attention and became crucial.    So, this thesis tried to analyze the reform and influence of SGP by the so-called “Soft Law” governance under the MLG system in EU. And some dimensions will be examined through this approach in SGP case: 1. The policy competence is shared at different levels and not monopolized at single level. 2. The diversities of economics and politics are different in member states. 3. Member States’ sovereignty of intension and areas are impacted by the control of the EU level.    Finally, by examining the SGP case through the governance with “soft law” concept, we can conclude that, because of the shortage of “hard law” and the interaction between supranational and national level, the SGP policy must be merged with hybridity governance-hard and soft law governance to reach its goal. At same time, we have also pointed out the new governance of soft law was a sample of power politics in the thesis until now.
