    摘要:   人民不服行政機關所為行政處分,提起行政救濟之目的,在於排除行政處分所造成之侵害,設若經冗長行政救濟之結果,人民雖獲得勝訴之結果,然其所欲救濟之權利,早因行政處分之不停止執行,致造成難於回復之損害,則其行政救濟將歸於徒勞,對人民權利之保護顯有不週;故而,應有一套暫時權利保護措施,使原行政處分於行政救濟中暫時停止執行,人民基於憲法所賦予之訴願與行政訴訟權利,方能獲得確保。   反之,若行政處分於人民提行政救濟時即停止執行,而行政救濟之結果,行政機關獲得終局勝訴。則亦可能因冗長行政救濟之進行,致有諸多行政處分欲達成之公益,受到重大之損害。且人民亦將動輒藉行政救濟,以阻撓行政處分執行,則對國家行政效力及公益,亦將造成重大之影響。   為使行政機關得以迅速實現公益目的,又能兼顧人民權益之保障,自應有一套完善之行政處分停止執行法制,合法考量公益與人民權利之輕重緩急,以決定於行政救濟中,原行政處分應否停止執行。   我國訴願法與行政訴訟法就原行政處分之執行,向採不停止執行原則,於民國八十七年訴願法與行政訴訟法大幅修正時,就此部分,雖仍延續舊有法制,續採不停止執行原則,惟為兼顧人民權益之暫時保障,乃仿德國及日本立法例,增設例外停止執行之相關規定,於符合法定要件情形下,即得停止原行政處分之執行。新制訴願法與行政訴訟法,自八十九年七月一日正式施行,其成效如何,亟須予以探討。   又我國停止執行法制係初次參酌德、日法制中之部分內容而制定,條文之疏漏、不完整與競合衝突所在多見,諸如聲請停止執行之時期之不明確、決定機關之重複競合、訴願法與行政訴訟法停止執行要件之不一致、訴願法未規定停止執行之審查程序及效力內容等均屬之,另實務見解就法律之適用與解釋亦有諸多歧異,與立法者立法時之預期,亦有重大落差。解決上述問題及兼顧行政效力與人民權利之保障,乃本文主要之研究動機與目的。   經蒐集最行政法院自新制訴願法與行政訴訟法施行以來,迄九十四年四月三十日止,所有行政處分聲請停止執行之案例計三百二十一件中,獲得停止執行者,竟僅有十件,可謂鳳毛麟角,施行成效,顯不如預期。   本文除細嚼相關實務案例見解外,並參考德、日停止執行相關法規範及國內學者論著學說與修法之立法理由,針對法律規定之妥適性與適用疑義及實務見解,逐步研討分析,提出本文見解,期以淺見,提供實務運作之參考,與將來修法之建議。
      The purpose of judicial remedy is to prevent citizen from injured by administrative agency’s administration action. So while the process of judicial remedy is too cumbersome and during the processing, the controversial injured administrative action not been suspend, then the petitioner’s right still could not been protected.   But if the controversial administrative action been suspended right after petitioner instituting legal proceedings, then the public interest will also been harm when the court upheld administrative agency’s controversial action.    So an appropriate legal system to temporary suspend the controversial administration action is necessary for protecting the citizen’s right.    Taiwan’s complaining law and administration proceeding law used to adopt the non-suspending principle. And even amended at 1998, they still been maintained, but imitate the German and Japanese example, under some statutory conditions, there are exception allowed to suspending the controversial administrative action. Effecting at July 1, 1998, it is still necessary to study how this new rule functioning.    Because of imitating the German and Japanese legislation example and lacking of experience, there are many careless omissions, contradictions in the words of statutory. Take for example, the conditions of appealing suspending are vague, the decision offices are overlap, the conditions of enforcing suspending in the complaining law and administration proceeding law are inconsistency, and the reviewing process and efficacy of suspending absent in complaining law, etc. There are also some seriously conflicts between the practice of legal applying and explaining and the expectation of lawmaker.   To study the above questions is the major purpose of this dissertation. This dissertation collected 321 cases applying for suspend to controversial administration action and found that only 10 cases were approval. So the function of it is out of expectation.    This dissertation studied some opinions from practice, referring to some scholar ideas, the reasoning of amending, and the theories of German and Japanese relevant norms for raising some humble opinion about the future amendment.
