    摘要:   正版與盜版間的戰爭早已持續數十年,善與惡的觀念也隨之同行。在過去的研究中,往往從個人道德倫理、國家整體經濟文化、法律知識風險等,來解釋盜版行為的發生,而業者的說法與官方的態度,也早已把盜版視為一種犯罪行為,甚至是社會問題。但綜觀現今關於盜版的各種論述,卻都無法回應到或解釋一個最主要的問題-「人們為何消費盜版」。是不肯買正版?還是買不起正版?買不到好的正版,進而弱化了買正版的意願與興起使用替代品的想法?反而只想藉由嚴峻的法令,透過加重刑法、落實執法與強化智慧財產權教育的方式,來規範人們的行為,並聲稱此方式是「重典」。   盜版已經在台灣社會中成熟化為一個被高度重視的議題,反盜版的力量也不斷蓄積,但像買不起正版或買不到好正版這些核心的問題,卻是被忽略的,且嚴重到不成「問題」,更別說隱藏在商品背後的知識壟斷性、商品剝削性、權力關係與文化同質性等問題。如果無法對症下藥,那麼我們到底在「反什麼」盜版呢? 所以,本文首先描述台灣的反盜版行動,是在何種時代氛圍與社會條件下被運作著。其又透過什麼樣的權力論述系統來支持著行動的擴展,最後它又獲得何種成果。進一步地,我們必須來檢視並解構這一系列的論述,其聲稱是否有其正當性與合理性存在,它是否解決了盜版的問題,亦或是透過良善的包裝來尋找代罪羔羊。   最後作者藉由生產與消費的角度來重新看待正版與盜版的關係,因為無論正版或盜版,它都是商品,也是消費行為,更反應了生產結構的問題,不能用簡單的善、惡來二分。事實上正版與盜版的使用者是二個差異化的社群,不過也會有重疊與流動,其消費物,不僅牽涉到價格因素,更是認同、區別,階層化、品味、教育等問題,並經由物的體系再現出人與人的關係。事實上沒有一個可以禁絕盜版的方式,只有透過強化使用正版的基礎與動機,來降低盜版的使用率。雖然這會走向符號消費與炫耀性消費,甚至是加深階級差異,是社會學家最不樂見的方式。但我們也別忘了,布希亞所預視的消費社會,確實是現今的常態,且沒有任一機制可以消弭這已存在的習慣。
      The fighting between piracy and copy right has been consisting for more then decades. Hence, the conception of what is right to wrong also in this discussion. In the past, the research always put the moral ethic, states-economy culture, and legal- risk to make explanation for piracy. Even the same idea provide for government and record manufacturers to put the piracy into criminal behavior. But be honestly, we can’t even find a one respond for-why people want to buy privacy product? Is it can't afford the price? Either way doesn’t want to do? Or simple answer-coz they can't find a good copy right product instead of buying the piracy. All we know is government set a more highly standard to punish people who make copy or even buy that, they also decline it is the way to discipline this issue.   Nowadays Anti-piracy is the main issue for society of Taiwan. The authority of anti-piracy is also surpassing for either can’t afford the price or can't find a good product. Otherwise if we ignoring it, how can we penetrate the authority behind customer, monopoly ideology, culture sphere to crystallize the piracy behavior. So that the main point of this research is to describe the anti-piracy action in Taiwan. How does it be active in our society within argument to support this movement? Finally what’s the result of this action? Furthermore, we have to retrospective the whole arguments of the general or reasonable existing. To find out is it truly solves the piracy problems or just put the wrong to right idea to punish the non-rational customer.   We criticize the production and consumption to re prosecute the relationship between piracy and copy right. However it is or not piracy it is product, also respond the structure of production. Not only wrong to right can fix this problem. In fact, the user of piracy or not separate two different hierarchies but sometimes combined together depends on user's identity, distinguish, taste, education problems. Honestly, there's no way to ban on piracy, the only way we can do is supply the foundation and motivation of copy right to reduce the user from piracy. Although it will become Conspicuous and Symbol Consumption or remarkable the distinguish within class, the way sociologist un pleasant with. But don't forget the consumption society that Baudrillard argued has been our social life now, and no state law can immune the existing habit of human-being.
