    摘要: 　　人權思想起源於歐洲，人權亦是歐盟的核心價值之一。但是，初期成立的歐體發展重心卻較著重於經濟方面，有關人權面向的政治性議題顯得較不關心；歐洲議會和歐洲法院於此時期在歐體人權保障的發展上卻有相當大的助益，前者發表許多有關人權的宣言或文件，後者發展判例使人民有法源基礎得請求救濟。　　　人權是歐盟的核心價值，歐盟要求人權紀錄不良的國家改善其不良的人權狀況，深信人權係具有普世的價值，歐盟亦常以人權作為外交的目的。然而，現今歐盟有關人權政策一遇到國際政治與經濟利益的影響時，似乎會有所阻礙，尤其以歐盟對中國人權外交的實際狀況為例，更顯可證。　　　本篇論文的目的，係針對歐盟人權法制與政策作一整體說明，並對之加以評估，希冀令國人能對之有更明確的認識與了解。除緒論與結論外，全文共分為四個部分：第一部分就人權思想的起源與歐盟人權保障發展的歷史作一介紹；第二部分探討歐盟保障人權的法制和制度的內涵；第三部分針對歐盟人權政策作一探討，尤以對中國人權外交此一面向為研究重點；第四部份針對歐盟人權外交實踐的情形作一綜合評析。
    　　The thoughts of human rights come from Europe, and human right is also one of the core values of European Union（EU）.However, European Community（EC）focused on the economic dimension in the beginning, and it didn’t care about the political issues, as human rights; European Parliament（EP）and the court of justice did a lot of help to the developments of EU’s human rights during this period. EP made a lot of declarations and documents; the court of justice made cases to be peoples’ fundamental legal origin. 　　　Human right is the core value of EU. EU asks countries which have bad human rights records to change those, and believes that human right has universal values. Human right is also the purpose of EU’s diplomacy. Nevertheless, it seems difficult to go on when EU’s human rights policies meet the influences of international political and economical benefits. Especially, EU’s human rights diplomacy to China is a clear evidence to prove what above I said.　　　Making a completed description and estimation about EU’s human rights legal system and policies is the purpose of this thesis, hoping to make people understand it more clearly. In addition to the introductory and concluding comments, the study of this research also includes fore main parts: first part describes the history of human rights and the development of protection human rights in EU; second part sets out the contents of this legal system and policies; third part sets out the contents about the human rights diplomacy to China; fourth part estimates the situation of human rights policies practice.
