本研究在於探討過往10年間校園常見或有較大可能性遇到的法律訴訟案件的判決為研究對象,評釋其內容的環境、事實過程、各方見解和結果,未來若遇到相關校園法律訴訟風險時,能做好事前預防、過程安全管理和避免責任上身,以減少校園法律訴訟風險,並根據研究成果提出建議,以供學校和教育主管機關參考。 本研究採取文獻資料分析法,以法院判決書為研究對象,計有民事判決書10則案例和刑事判決書15則案例,共25則判決案例進行評釋分析。根據研究,教師若要避免訴訟或在訴訟全身而退的獲致結果如下:一、訴訟要充分表達自己主張並舉證二、平時做好書面記錄可防範訴訟產生三、學校和教師做好宣導安全注意事項可防止學生受傷而遭訴訟四、有維護校園設施和設立使用規則可避免因他人使用不當而被牽連五、教師須主動瞭解更新的法規條文規範以避免無知受罰六、確實檢查和改善教育部規定檢核表項目,可減少疏漏而致訴訟發生 This study is to explore the campus the past 10 years have a greater likelihood of encountering or common law litigation judgment for the study, environmental assessment release its contents, the fact that the process, the parties and the results of opinion, if the future encounters campus law when the risk of litigation can do advance the prevention, process safety management responsibility and avoid the upper body, in order to reduce the risk of legal proceedings campus, and make recommendations based on the research results, for schools and education authorities a reference. This study literature analysis taken to the court verdict as the research object , namely, civil judgments and 10 cases of criminal judgments 15 cases , a total of 25 cases were evaluated release decision analysis . According to the study , teachers to avoid litigation or litigation to get out of attainable results are as follows :I. Litigation to fully express their ideas and evidence.II. Usually do produce a written record can prevent litigation.III. schools and teachers do security advocacy precautions to prevent students who were injured in the proceedings.IV. There are maintaining campus facilities and the establishment of rules can avoid the use of improper use of others have been implicated.V. Teachers should take the initiative for updated statutory provisions regulate in order to avoid punishment ignorance.VI. Check and improve Jiaoyu Bu indeed predetermined checklist items can reduce omissions caused litigation.
